
In a 5-4 decision the Supreme Court decided today to uphold Texas District Judge Drew Tipton’s challenge to an immigration policy directive issued in September of last year by Alejandro Mayorkas, Secretary of Homeland Security. In the
DOJ had asked the Supreme Court to stay Tipton’s decision, effectively restoring the long-established (and previously unchallenged) practice of such directives being handed down to agents in the field by the Homeland Security Secretary. Through this decision, the Supreme Court denied DOJ’s request, on a temporary basis. The final decision will come down in December.
